One of the hot topics is Indiana Code 5-23 Building, Operate, Transfer (BOT). This code has been in effect for approximately seven years and can only be used by public entities such as cities, towns, counties and townships. It is a procurement model for public entities to get capital projects done. Under this code, the development, construction and design can be procured based solely on qualifications. This model allows for a faster procurement process, lowering insurance costs, avoiding a public bid process, guaranteeing pricing on financing and construction [in a] transparent open book process and mitigating all risk to the public entity.  Essentially, it is a private-public partnership.
